This study focuses on the issues of ensuring and implementing the constitutional rights of citizens of the Republic of Kazakhstan to reproductive health protection in the context of the development of modern assisted reproductive methods and technologies, as well as their integration into the system of compulsory social health insurance. The study provides a comprehensive legal analysis of the regulatory legal acts of the Republic of Kazakhstan in the field of reproductive medicine and reproductive rights, including an assessment of their content in terms of compliance with the norms of the Constitution, national and international law. Special attention is given to the fact that an effective fight against infertility should include not only therapeutic measures for treating or overcoming infertility, but also preventive measures aimed at its prevention. In this context, the need to expand the list of ARTs funded under the OSMS, including programs to preserve the fertility of citizens, is justified. It is noted that the use of methods and technologies for cryopreservation of gametes and embryos can become an important factor in improving the reproductive health of the population, contributing to improving demographic indicators, strengthening the institution of the family, and preserving marital relationships. The results of the study confirm that the classification of these methods and technologies as types of specialized high-tech medical care provided in the OSMS system is appropriate from both a clinical and socioeconomic perspective. The authors' proposals for improving the legislative framework of the Republic of Kazakhstan, expanding citizens' guaranteed access to ART, strengthening mechanisms for monitoring the content of legal acts and legal protection of citizens, as well as implementing information support programs aimed at increasing the legal and medical literacy of the population, can ensure compliance with the constitutional rights of citizens and strengthen social and legal guarantees in the field of reproductive health protection.
