The research investigates parole as a system which enables society to reintegrate offenders through controlled procedures while studying its implementation across European Union member states and Commonwealth of Independent States nations with special emphasis on Kazakhstan's legal framework. The research aims to establish legal differences while creating operational suggestions which will enhance parole management through its three components of normative framework and procedural system and institutional structure. The research shows that parole needs to operate as a judicial body which grants prisoners legal rights to support their rehabilitation process and uphold proper sentencing and established legal procedures. The research uses doctrinal and comparative and case-law methods to study national parole systems and European Court of Human Rights decisions about the "right to hope" through evaluation of parole decision-making tools. The study shows that life imprisonment sentences need to undergo a required first evaluation process which should be followed by scheduled judicial assessments that must follow established legal procedures instead of depending on executive pardon. The research results demonstrate that a motivation matrix needs to exist which uses behavioral signs together with treatment results and victim perspectives for assessment. The research adds value to comparative criminal law through its work to organize European and CIS parole standards which it then applies to the Kazakhstani legal system. The proposal includes legal modifications which will assist courts and correctional facilities and probation services to achieve improved decision-making while safeguarding human rights throughout parole proceedings.
