Статья посвящена проблемам исполнения наказания в Республике Казахстан и путям их совершенствования. По мнению автора, важно обратить внимание на следующие моменты: необходим поиск новых концептуальных подходов в решении вопросов исполнения наказания (в том числе улучшение состояния исправительных учреждений; искоренение негативного влияния групп асоциальной направленности; создание достойных трудовых условий для осужденных к лишению свободы, решение социальных проблем осужденных; модернизация системы исполнения уголовных наказаний); важно продолжать совершенствование отдельных аспектов исполнения наказаний; существует необходимость материально-технического укрепления системы исполнения наказаний; важно обеспечение прав и законных интересов осужденных в период отбывания наказаний; отдельное внимание следует уделить совершенствованию вопросов трудоиспользования осужденных в процессе исполнения наказаний; необходимо совершенствование системы обучения осужденных, а также изменение сложившихся антагонистических отношений между осужденными к лишению свободы и администрацией учреждения (в том числе создание при учреждениях уголовно-исполнительной системы отделов (групп), которые занимались бы в рамках пенитенциарной пробации проблемами осужденных); необходимо дальнейшее совершенствование уголовного и уголовно-исполнительного законодательства РК; важно уделять больше внимания решению вопросов социальной реабилитации осужденных. Автором подробно рассмотрены имеющиеся на сегодняшний день проблемы и предложены направления совершенствования системы УИС в Республике Казахстан. The article is devoted to the problems of punishment enforcement in the Republic of Kazakhstan and ways to improve them. According to the author, it is important to pay attention to the following points: it is necessary to search for new conceptual approaches to solving issues related to the execution of punishment (including improving the condition of correctional facilities, eliminating the negative influence of antisocial groups, creating decent working conditions for those sentenced to imprisonment, and addressing the social problems of convicts); it is important to continue improving certain aspects of the execution of punishments; there is a need to strengthen the material and technical base of the execution system; it is important to ensure the rights and legitimate interests of convicts during their incarceration; special attention should be paid to improving the employment of convicts during the execution of punishments. It is necessary to improve the system of training convicts, as well as to change the existing antagonistic relations between convicts to imprisonment and the administration of the institution (including the creation of departments (groups) at the institutions of the penal system, which would deal with the problems of convicts within the framework of penitentiary probation); it is necessary to further improve the criminal and penal legislation of the Republic of Kazakhstan; it is important to pay more attention to solving the issues of social rehabilitation of convicts. The author has examined in detail the existing problems and proposed directions for improving the system of the penal system in the Republic of Kazakhstan.
